1. GENERAL PROVISIONS

1.1. This Privacy Policy (hereinafter referred to as the “Policy”) sets forth the relations in the field of the protection of personal data of visitors to the website, and establishes the procedure for the collection, storage, use, and protection of the personal data of natural persons (hereinafter referred to as the “Data Subject” or the “Benefactor”) provided to the Charitable Organisation “Charitable Foundation ‘Assistance to Ukrainians from Europe’” (hereinafter referred to as the “Foundation”) in connection with the making of a charitable donation or any other interaction with the Foundation.

1.2. The Foundation is registered and operates in accordance with the legislation of Ukraine.

1.3. In this Policy, the terms shall have the meanings ascribed to them by the legislation of Ukraine, in particular:

  • personal data – information concerning a natural person who is identified or who may be identified;
  • processing of personal data – any actions performed with respect to such data (collection, storage, use, and the like);
  • data subject – a natural person whose data are being processed;
  • cookies – small text files stored in the user’s browser.

All other terms used in this Policy shall be construed in the meaning ascribed to them by the applicable legislation of Ukraine, including international legal acts ratified by Ukraine.

1.4. By making a donation or by any other interaction with the Foundation (correspondence by e-mail, through social networks, the website, and the like), the Data Subject confirms that he or she has familiarised himself or herself with this Policy and grants consent to the processing of his or her personal data in accordance with the terms set forth herein.

1.5. This Policy is governed by:

  • the Constitution of Ukraine;
  • the Law of Ukraine “On the Protection of Personal Data”;
  • other regulatory and legal acts of Ukraine;
  • international norms.

1.6. The controller of personal data is the Foundation. The Foundation may engage third parties (payment systems, technical services) for the purposes of data processing.

1.7. The data subjects are all users of the Website, in particular those who make donations or communicate with the Foundation.

1.8. The Foundation guarantees compliance with the legislation, the protection of personal data, and the prevention of unauthorised access thereto.

1.9. In the event of disagreement with the terms of this Policy, the Data Subject shall refrain from transferring his or her personal data to the Foundation.

2. PROCESSING OF PERSONAL DATA

2.1. The Foundation may collect and process the following information about you:

  • information that you provide to the Foundation: this is information about you that you provide by way of using the Website and the Website’s functionalities, subscribing to receive updates by e-mail, providing charitable assistance (donations) by way of the functionalities of the Website, communicating with the Foundation through the functionalities available on the Website, and the like;
  • information about you that is collected by the Website and other systems:
    1. when you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, the pages of the Website that you visit, and your Internet Protocol (IP) address;
    2. the Website may also load cookies onto your device;
    3. when you contact the staff of the Foundation by means of the Website or other means of electronic communication;
  • information about you that is collected by third parties on the Website by means of certain actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter) when using the social media sharing functionalities available on the Website, when navigating from one page to another, or when viewing materials that contain links (which open) to other platforms (websites).

2.2. The manner in which the Foundation processes your personal data depends upon the manner in which you use and interact with the Website. A portion of the information may be provided directly by you in the course of using the Website or by other means; other information may be collected and processed by the Foundation independently by means of automated technologies employed on the Website.

2.3. Legal grounds for the processing of data: when you visit the Website, the Foundation processes your personal data where:

  1. the Foundation has obtained your consent to such processing;
  2. your personal data are necessary for the Foundation to enter into and perform a transaction with you, or for the carrying out of measures preceding the conclusion of a transaction;
  3. the Foundation has a legitimate interest in processing your personal data, and such legitimate interest is not overridden by your interests in respect of data protection or your fundamental rights and freedoms;
  4. in any other instances provided for by the applicable legislation.

In certain instances, the Foundation may have a legal obligation to process your personal data, or may process your personal data for the establishment, exercise, or defence of legal claims.

2.4. Mechanisms of automated processing: the Foundation and third parties may employ technologies of automated information processing for the purposes of processing information in certain sections of the Website. The Foundation uses cookies for the storage of content and settings, which enables the Foundation to process the standard information that your browser transmits to certain websites that you visit, such as your IP address, the type and language of your browser, the website from which you have navigated, the pages that you visit, and the links upon which you click on the Website. The availability of such technical information assists the Foundation in improving the Website.

2.5. The Foundation may use your personal data solely for the purposes set forth in this Policy and the applicable legislation, and in particular (but without limitation):

  1. for the purpose of processing your request (enquiry) to the Foundation made through the Website;
  2. for the purpose of facilitating the provision by you of charitable assistance (donations) by means of the functionalities available on the Website;
  3. for the purpose of implementing the other statutory objectives of the Foundation in the manner prescribed by the applicable legislation;
  4. for the purpose of dispatching to your e-mail address letters and notifications relating to advertising (promotional) materials, information regarding the commencement of charitable projects, requests and invitations for the provision of feedback on matters of charitable activity, visits to the web resource, and the like.

2.6. The Foundation may accumulate personal data processed in the course of your visit to and use of the Website, including by way of entering such data into a database of personal data. The storage of your personal data shall be carried out in compliance with the requirements of the applicable legislation in the field of personal data.

2.7. The dissemination of your personal data shall be carried out exclusively with your consent or in the instances set forth in this Policy and the applicable legislation.

2.8. The Foundation may partially publish user data on its Website in the “Reporting” and “Receipts” sections.

2.9. Your personal data shall be subject to deletion or destruction in the event of:

  • the expiration of the two-year period of storage thereof, or any other period prescribed by the applicable legislation;
  • the termination of legal relations between the data subject and the Foundation, save where otherwise provided for by the legislation;
  • any other instances prescribed by the applicable legislation in the field of the protection of personal data.

2.10. The Foundation does not process personal data concerning racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties or trade unions, criminal convictions, or data relating to health, sexual life, or biometric or genetic data, save in the instances prescribed by the legislation.

3. RIGHTS OF DATA SUBJECTS

3.1. When visiting or using the Website, you shall have the right to:

  • receive from the Foundation information not specified in this Policy concerning the processing of, and conditions of access to, your personal data, or to issue a corresponding instruction for the receipt of such information by persons authorised by you, save in the instances prescribed by the legislation;
  • free-of-charge access to your personal data;
  • receive a response to a request concerning the processing of your personal data in the manner and within the time limits prescribed by the applicable legislation;
  • submit a reasoned demand objecting to the processing of your personal data, or requesting the alteration or destruction of your personal data, where such data are processed unlawfully or are inaccurate;
  • the protection of your personal data from unlawful processing and from accidental loss, destruction, or damage in connection with deliberate concealment, non-disclosure, or untimely disclosure thereof, as well as protection against the disclosure of information that is inaccurate or that defames the honour, dignity, or business reputation of a natural person;
  • withdraw your consent to the processing of personal data, and to exercise such other rights as are prescribed by the applicable legislation in the field of the protection of personal data.

3.2. You shall have the right to address questions relating to the collection, use, storage, or any other processing of your personal data to the Ukrainian Parliament Commissioner for Human Rights, who may be contacted via the e-mail address hotline@ombudsman.gov.ua.
